Terms of Trade.

1. Account and Verification

We deal exclusively in B2B transactions. All new buyers must undergo a verification process. We reserve the right to request business registration documents, VAT/GST numbers, and industry references before confirming any orders or granting access to our complete inventory pricing.

2. Pricing and Payment

All prices are quoted in USD unless explicitly stated otherwise.

• Quotes are valid for 48 hours due to market volatility.
• Payment must be made via international wire transfer (SWIFT) or through approved escrow platforms.
• Full payment is required before the dispatch of goods unless a prior credit facility or memo agreement has been explicitly established and signed by our financial directors.

3. Shipping and Insurance

We utilize highly secure, specialized courier services (e.g., Malca-Amit, Brinks, or FedEx Secure) for all international shipments.

• All shipments are fully insured by Anand Exports until the package is signed for at the Buyer's designated delivery address.
• The Buyer is responsible for all local import duties, taxes, and customs clearance fees in the destination country.
• Title to the goods passes to the Buyer only upon receipt of full payment. Risk of loss passes upon delivery.

4. Grading and Certification

All diamonds above 0.30 carats are generally accompanied by an independent grading report from recognized laboratories (e.g., GIA, IGI, HRD). In the event of a discrepancy, the independent laboratory report shall be considered final. All rough diamonds are sold with their respective Kimberley Process certificates ensuring conflict-free origin.

5. Returns and Disputes

Returns are only accepted within 7 days of delivery and must be pre-authorized by your account manager. Goods must be returned in their original condition, in their original secure packaging, with all original certificates intact. The Buyer is responsible for secure return shipping and insurance costs. Any disputes arising from these Terms of Trade will be subject to the exclusive jurisdiction of the courts of Mumbai, India.

6. Conflict-Free & Kimberley Process Compliance

Anand Exports warrants that all rough diamonds supplied are accompanied by a valid Kimberley Process Certification Scheme (KPCS) certificate confirming conflict-free origin, in compliance with the Clean Diamond Trade Act and India's Gems & Jewellery Export Promotion Council (GJEPC) requirements. The Buyer warrants that it will not knowingly deal in conflict diamonds and will maintain records of all KPCS certificates for a minimum of five (5) years as required by applicable law.

7. Limitation of Liability

Anand Exports' total liability to the Buyer for any claim arising out of or in connection with these Terms, whether in contract, tort, or otherwise, shall not exceed the invoice value of the specific goods giving rise to the claim. In no event shall Anand Exports be liable for indirect, consequential, incidental, or punitive damages, including loss of profit or business opportunity.

8. Force Majeure

Neither party shall be liable for delays or failure to perform obligations arising from circumstances beyond reasonable control, including but not limited to natural disasters, war, government actions, pandemics, mining disruptions, or international sanctions affecting the diamond trade.

9. Governing Law & Dispute Resolution

These Terms of Trade shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms that cannot be resolved by mutual negotiation within 30 days shall be referred to binding arbitration under the rules of the Indian Council of Arbitration (ICA), Mumbai. The seat of arbitration shall be Mumbai, Maharashtra. Each party shall bear its own costs unless the arbitrator directs otherwise. Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.

10. Intellectual Property & Site Usage

All content on this website, including but not limited to 3D models, photography, branding, text, and design, is the exclusive intellectual property of Anand Exports. Visitors, competitors, and buyers may not copy, scrape, reproduce, or use any part of this website for their own commercial benefit, competitive advantage, or to misrepresent an affiliation with us. Unauthorized use of our digital assets is strictly prohibited.
